Besides other methods of collecting information explicitly stated in this policy, Anaanse may gather (a) the email addresses of users who communicate with Anaanse via email, and (b) data provided by users on our Site in information sections, such as any contact information, registration or application forms, and racial or ethnic origin.
Anaanse will not participate or take any responsibility for any interaction that occurs between students and businesses, except for the purposes necessary for maintaining our services. Your interactions with any other individual or entity through our services or as a result of using our services, including those between businesses and students, are solely your responsibility. Anaanse is not responsible for any interactions between students and businesses and explicitly disclaims any responsibility for employment or contracting opportunities, employment or contracting services, or any other services or products acquired through our services. Even if Anaanse attempts to verify any information related to these opportunities or services, we disclaim any responsibility for them. You must assess and assume all risks associated with using our services, including service materials and user content, and must not rely on them.
The usage of our Services is subject to the following Terms and Conditions ("Terms"). These Terms include all other regulations, policies, and procedures mentioned in them or published by Anaanse on our website or any App (including our Privacy Policy). By using our Services, you acknowledge that you have read and understood these Terms, including the Policies, and agree to abide by them. If you do not agree with these Terms, or if you are below 18 years of age, you are not authorized to use our Services and should leave immediately.

To access specific content, services, products, or benefits on our Services, you will need to register and create an account. By registering an account, you confirm that you are 18 years or older. Depending on your intended use of our Services, you may need to specify if you are registering as a Job Seeker (i.e., for a Student or talent) or an Employer (i.e., for a Business). Your rights and obligations under these Terms may vary based on the account type you register for. During the registration process, you may need to provide certain personally identifiable information, such as your email and postal addresses, phone numbers, and employer or educational institution, as requested by Anaanse. You agree that the information you provide at the time of registration and any other time will be truthful, accurate, current, and complete. You also agree to maintain accurate and up-to-date information at all times. Any information provided to Anaanse through our Services or email will be subject to Anaanse's Privacy Policy, which is incorporated into these Terms by reference.
Upon registering with our Services, you give Anaanse consent to verify any statements or guarantees you make during the registration process or in any materials submitted. This includes conducting background checks, reaching out to provided references, and examining public records. While Anaanse has the right to verify these statements and guarantees, it is not obligated to do so and may choose not to at its own discretion.
After registering, a Business can use our Services to submit a notification to Job seekers about potential employment or contracting opportunities in the form of a "Job Posting." Each Job Posting may only notify Job seekers about a single employment or contracting opportunity and must include at least the position title and job description. Once a Job Posting is submitted, the Business cannot make significant changes. Anaanse may correct minor typographical errors but is not required to do so.
It is essential that you carefully review and comprehend the Privacy Policy, particularly because the Services involve the collection and utilization of personal data and personally identifiable information ('Personal Data'). The most current version of the Privacy Policy will be applicable to your use of the Services. Anaanse will not knowingly alter, change, or share your Personal Data in connection with the Services except in the following circumstances: (a) as required for Anaanse (or its service providers) to offer the Services and respond to your inputs, (b) to communicate with you, (c) as permitted under the Privacy Policy or elsewhere in these Terms, (d) when Anaanse reasonably believes that such action is necessary to meet any legal, regulatory, law enforcement, or similar requirement or investigation, to protect or defend the rights or property of Anaanse or any third party, or to enforce the Terms, or (e) as authorized by you.
Anaanse offers various Services, and some of them, including the ability for Businesses to post job openings, can be acquired through purchase. You will be responsible for all charges incurred through your account, whether made by you or someone else who uses your account. If Anaanse does not receive payment for any purchase, it reserves the right to take legal action, including immediately suspending or terminating your account, seeking collection of the outstanding amount, and pursuing legal action for any breach of these Terms. You will also be responsible for paying any applicable government taxes associated with the use or purchase of our Services, such as sales, use, and excise taxes, excluding only taxes on Anaanse's net income. If Anaanse is required to collect such taxes, the applicable tax will be added to your billing account. All sales are considered final. Anaanse will not be liable for any expenses or costs related to any interactions between Businesses and Job seekers.
Anaanse owns or licenses all of the content, graphics, data, images, software, and other materials on or made available through our Services, including any apps and functional components ("Services Materials") unless otherwise specified in an agreement between you and Anaanse. Anaanse retains all rights, titles, and interests in the Services Materials, as well as their arrangement, organization, and enhancement. The Services Materials are protected under copyright, trademark, and patent laws, among others. Any names, trademarks, service marks, certification marks, symbols, slogans, or logos displayed on the Services are the property of Anaanse, its affiliates, licensors (such as Businesses), or suppliers. Using these trademarks without permission is prohibited and may violate federal and state trademark laws. Except for the right to use the Services Materials in accordance with these Terms, you have no rights to them.
By using our Services, you agree not to engage in any illegal or unauthorized activities that violate any local, national, or international laws. This includes import, export, copyright, trademark, and employment anti-discrimination laws. Additionally, you must not contact any user of our Services who have requested not to be contacted or engage in stalking or harassment. You must not use data mining, scraping, or other data gathering or extraction tools to collect information from our Services unless they are indexed by general-purpose public search engines. You must not use our Services to compete with Anaanse or cause a reduction or loss of business for Anaanse as related to an existing or potential customer. Furthermore, you must not modify, copy, distribute, display, reproduce, publish, license, create derivative works from, transfer, sell, or use our Services or Services Materials unless authorized by these Terms or in a separate written agreement with Anaanse. You must not attempt to gain unauthorized access to our computer system or interfere with the performance of our Services or the functionality of any Services Materials. You may not use our Services to access or collect any personally identifiable information or to violate any community or Internet standards of decency. Moreover, you must not use our Services to send spam or other unauthorized or unsolicited advertising, junk, or bulk e-mail or messages, except as provided in any agreement with Anaanse providing you access to bulk messaging. You must not remove, circumvent, disable, damage or otherwise interfere with any security features of our Services aimed at preventing or restricting the unauthorized use of our Services or any of the Services Materials. A Business may use our Services to create and maintain a culture of workplace diversity and inclusion but may not use our Services to unlawfully discriminate against any job seeker. Any other use of our Services or Services Materials without prior written permission from Anaanse is strictly prohibited. You acknowledge that the unauthorized use of our Services or Services Materials could cause irreparable harm to Anaanse and that in such cases, Anaanse shall be entitled to an injunction in addition to any other remedies available at law or in equity.
Anaanse provides our Services for informational purposes only, and we are a private company not affiliated with any educational institution or Business, including universities and colleges. Our Services may include links to other websites on the Internet that may be useful to users, as well as features and services provided by third parties, including payment processing. However, the use of these third-party links, features, and services, our Services, and any Services Materials or other content available through our Services is solely at your own risk. Anaanse does not endorse or recommend the content, accuracy of the information, or quality of products or services provided by or advertised on third-party websites, or any transactions or agreements you enter into with third parties. You assume full responsibility for your use of any third-party website, which is subject to its terms and conditions, including those of our third-party payment processors. We do not endorse or support any products, services, or treatments provided on a third-party website, or that are advertised or provided on our Services.
Anaanse strives to maintain the availability of our Services, but there may be times when access to our Services is interrupted or not available. Anaanse will make reasonable efforts to minimize any disruptions within its control. You acknowledge and agree that Anaanse is not responsible for any changes, interruptions, or termination of our Services, and any fees paid under these Terms are non-refundable. Additionally, Anaanse may update, modify, suspend, or terminate the Services, in whole or in part, at its sole discretion and at any time.
The information provided on our Services is intended for informational purposes only. Notwithstanding any other provisions in these Terms, Anaanse is not accountable for any inaccuracies, omissions, or errors in our Services or the Services Materials. Anaanse, along with its subsidiaries and affiliates, does not ensure the accuracy or completeness of any Services Materials, User Content, links, products, data, services, or any other items offered on our Services, whether provided by Anaanse, job seekers or Businesses, or third parties. Anaanse has the right to remove any User Content or Services Materials at any time, without notice, for any reason or no reason. While Anaanse may choose to review, verify, change or remove any User Content or Services Materials, products or services available on or through our Services, it is not required to do so and cannot review all communications or products available through our Services.
Our Services and all materials available through them are provided "as is" and "with all faults." Your use of our Services is at your own risk. Anaanse and its licensors do not make any representations or warranties, and expressly disclaim all representations and warranties, regarding the User Content, Services Materials, services, products, data, and other materials available through our Services, whether express or implied, written or oral, arising from a course of dealing, course of performance, usage of trade, or otherwise. These include but are not limited to the implied warranties of merchantability, fitness for a particular purpose, accuracy, systems integration, non-interference, quality, title, and non-infringement. The entire risk regarding satisfactory quality, performance, accuracy, completeness, and effort with regard to any User Content, Services Materials, services, products, data, and other materials available through our Services, is with you. Anaanse and its licensors shall not be liable for any damages or harm arising from the use of our Services or the materials available through them.Anaanse and its licensors will not be held responsible for any kind of damages, including direct, indirect, special, incidental, consequential, exemplary, extra-contractual, or punitive damages that may result from your use of or inability to use the user content, services, materials, products, data, and other materials available through our services. This applies regardless of the legal theory and even if you or Anaanse were aware of the possibility of such damages. In any case, the total liability of Anaanse and its licensors to you or any other person or entity for any claims related to the user content, services, materials, products, data, or other materials offered through our services is limited to the amount you paid for the services and products during the preceding year.
Please note that some states may not allow the limitation or exclusion of liability for incidental or consequential damages, so this limitation or exclusion may not apply to you. If any part of this limitation of liability is found to be invalid or unenforceable, then the total liability of Anaanse and its licensors shall not exceed ten dollars ($10). If you are not satisfied with our services or if you believe that Anaanse has violated these terms, your only option is to stop using our services.
You shall indemnify Anaanse and its directors, officers, employees, agents, contractors, and licensors (collectively, "Anaanse Indemnitees") against any and all claims, actions, suits, or other proceedings (each, a "Claim") that arise in connection with your use of our services, including but not limited to claims related to fraud, violation of law, negligence, willful misconduct, or any other use of our services, user content, services materials, products, information, and other materials available through our services. This indemnification does not apply to claims that are attributable to Anaanse or any breach of these terms by Anaanse.
You will be responsible for paying all judgments, losses, liabilities, damages, costs, and expenses (including reasonable attorneys' fees and disbursements) that Anaanse Indemnitees incur in connection with such Claims. You may not settle any Claim without Anaanse's prior written consent. Anaanse or its licensors may assume the defense of any Claim, at your sole cost and expense, and you must cooperate in all reasonable respects in such defense. You have the right to employ separate counsel in any Claim and to participate in the defense thereof.
If Anaanse or its licensors do not elect to undertake the defense of a Claim, you have the right to defend the Claim with counsel reasonably acceptable to Anaanse, subject to Anaanse's right to assume the defense of any Claim at any time before the settlement or final determination thereof, at our sole cost and expense.
If you believe that any content or posts on our Services infringe on your intellectual property or other rights, please send a detailed message to Anaanse by email at hello@anaanse.com that includes the following information: (a) your name and your company's name (if applicable); (b) your contact information, such as your email address; (c) a description of your complaint, including the specific rights at issue, the objectionable content or posting, and the basis for your complaint; and (d) a statement affirming the accuracy and completeness of your message, and your full legal authority to make the statements, representations, and assertions contained therein, as well as any demands you make in the message.
Anaanse has the right to terminate your access to the Services, including any App, at any time and with or without notice, for any reason. If you want to terminate your registration and Services account, you can send an email to hello@anaanse.com that includes your email address. To terminate your account, you must follow the process described in this provision. Upon termination, all rights and obligations of the parties under these Terms will end, except for any obligations that accrued before the effective date of termination, all remedies for breach of these Terms, and any provisions of these Terms that should reasonably be understood to continue in effect. Anaanse may retain and use User Content and other data and business records resulting from your use of the Services, but not in a manner that discloses your identity. Unless otherwise stated, any order subject to these Terms will automatically renew for the same period as the current term unless either party provides written notice of non-renewal at least sixty (60) days prior to the end of the current term.
Changes to these Terms
These Terms do not create a partnership, joint venture, agency, legal representation, employer-employee, contractor or any other similar relationship between the parties.
The laws of Ghana shall govern and interpret these terms and conditions of use, without giving effect to any principles of conflicts of law. You agree that any legal action arising out of or related to these terms and conditions of use shall only be filed in the state or federal courts located in Ghana. By using our Services, you consent and submit to the personal jurisdiction of such courts for the purposes of resolving any such legal action.
Anaanse controls and operates its Services from Ghana. Anaanse does not make any representation that its Services, User Content, Services Materials, services, products, information, or other materials available on, in, or through its Services are appropriate or available for use in other locations. Access to them from territories where such materials are illegal is strictly prohibited. If you choose to access Anaanse Services from other locations, you do so at your own discretion and are responsible for complying with applicable laws. The waiver or failure of Anaanse to exercise any right provided in these Terms shall not be deemed a waiver of such right in the future or a waiver of any other rights established under these Terms. Headings used in these Terms are for reference purposes only and shall not affect the interpretation of these Terms. No person or entity who is not a party to this agreement will be considered a third-party beneficiary of these Terms or any of its provisions. The words "includes" and "including" and their syntactical variations used in these Terms shall be deemed to be followed by the words "without limitation." These Terms and Conditions of Use are governed by and interpreted in accordance with the laws of Ghana, without giving effect to any principles of conflicts of law. You agree that any legal action arising out of or related to these Terms and Conditions of Use must be filed exclusively in the state or federal courts located in Ghana, and you consent and submit to the personal jurisdiction of such courts for the purposes of litigating any such action.
Anaanse offers various Services that allow you to receive notifications or messages related to your Account, as well as information about products, features, services, or special offers that may interest you. For example, you may choose to receive Text Messages on your mobile phone that are connected to your use of the Services. Note that message and data rates may apply, and Anaanse is not responsible for any messaging or data charges incurred by you or any person who has access to your wireless device or phone number. You have the option to stop receiving email or Text Messages by sending an email to hello@anaanse.com, although Anaanse may still contact you through text messages or other means if it's necessary for account recovery purposes. You should be aware that opting out of receiving Text Messages may have an impact on your ability to use the Services.
